Criminal Law

Phoenix Criminal Law

At Billar & Donald P.C., we are dedicated to giving you the best criminal law defense possible. Our attorneys want you to know all the available options provided to you under criminal law. As a starting point, you should familiarize yourself with the overall criminal law process.

What is a crime?

A crime is an act in violation of the public law. The prosecutor, who represents the state, brings charges against you. Each state has its own criminal code. Conviction of these crimes results in fines, incarceration or both. This, in contrast to a civil suit, involves individuals and leads to various forms of restitution payment.

Crimes are divided into felonies and misdemeanors. Felonies are usually punishable by one or more years in jail, and include rape, assault, and murder. Misdemeanors are punishable by less then one year. Realize that many crimes fall into both categories; a lawyer can help minimize the charges brought against you.

Drug Offenses

Within Phoenix, the Drug Enforcement Bureau (DEB) is responsible for investigation of illegal drug crimes. This includes, but is not limited to, drug possession, drug trafficking, drug distribution, drug manufacturing and any other drug violations. There are many special sentencing provisions in Phoenix drug law, so it important to understand and consider them all. See our Phoenix Drug Crimes page.

DUI/DWI and Vehicular Offenses

If you have been involved in a drunk driving accident or arrest, you need attorneys with comprehensive knowledge of Arizona’s criminal law. Take a look at both our Phoenix DUI LAW and Phoenix DUI Process pages for more information.

Felony Murder

A felony murder is defined as killing with or without intent, while committing or fleeing from a felony.

Forfeitures

Asset forfeiture describes the confiscation of assets. This includes the proceeds of crime or items used in committing criminal acts, such as cars.

Fraud

Commonly known as a scam or deception, fraud is personal gain that damages another individual. Fraud involving money is a class 6 felony in Phoenix, Arizona. A fraud unit in the department of insurance is formed to compile the case against you.

Manslaughter

Separated into non-negligent and negligent, this refers to the killing of another person without intent. A common occurrence of negligent manslaughter is during a DUI accident. A non-negligent instance is self defense, but is nonetheless grouped with murder by the Phoenix Police Department.
